You might always have a high nitrate problem while over stocked. I did when I was over stocked. The fish didn't seem to mind. I ended up getting a group of Otos to help keep the algae in check.

The thermostat in the heater should self-regulate the device. If the temp is at or above the set (desired) temperature, the heater will remain idle and not heat the water. This is the idea anyways....
